The administrative act was declared invalid

The RA’s Administrative Court /Judge K. Baghdasaryan/ declared the decision of the "Traffic Police" of the RA invalid by the decision made on the administrative case No. VD / 1590/05/16.

The legal dispute concerned violation of the rules of stopping by the Plaintiff, and the respondent tried to clarify the concerned legal rule only during the trial. Meanwhile, we stated in the lawsuit that such a position from the respondent does not follow from the requirement of certainty of the administrative act, as the respondent has the obligation to define the administrative act during the administrative proceedings, the mentioned duty also derives from the principle of legal certainty, otherwise the traffic police may make unfounded or uncertain decisions and try clarifying the legality of its decision only during the trial.

On this basis, the RA’s Administrative Court concluded that the act concerned is invalid.
