The administrative act of the traffic police was declared invalid

The RA’s Administrative court, by the decision made on 14.04.2017 in the administrative case No. VD/1296/05/17, made invalid the act taken by the Road Traffic Police.

The inspector of the Violation Detection center found that the driver of "MAZDA" vehicle with license plate number 697OR61 on 09.01.2017 at 13:39 in the section of Azatutyun / Babayan crossroads in Yerevan did not observe the requirements of No 955-N decision of the Government of the Republic of Armenia, particularly  the point 80 of Annex 1; the vehicle is located not parallel to the edge of the roadway. The video, which was the basis of the decision showed the section of Azatutyun/Babayan intersection in Yerevan, where there was a local widening, but no ‘Additional Information Sign’ was available, a requirement imposed by the same Government decision.

Moreover, the Administrative court rightly pointed out that the mentioned local widening space can’t be classified as driving space as after the assessment of the video, it is obvious that the vehicles parked in the mentioned section do not hinder the vehicles traveling in the first lane in any way.

Based on the above-mentioned legal and factual grounds, the Road Traffic Police decision was invalidated.
