Subjected to Administrative Liability for Blocking the Vehicle Registration Plate

According to the decision of the "Traffic Police" service of the Republic of Armenia Police, the plaintiff was subjected to administrative liability based on Article 123.5, Part 1.1 of the Code of Administrative Offenses of the Republic of Armenia, with a fine of 25,000 AMD.
According to the decision, the plaintiff had blocked the vehicle registration plate number, which violated the requirements of Article 24, Part 1 of the Road Traffic Safety Rules.
The court, considering the legal positions presented by the parties, did not find the defendant's arguments convincing in proving the fact of blocking the vehicle registration plate number, as the discovery of this fact required the competent administrative authority (the Service) to gather and document specific factual data and information as stipulated in Article 251 of the Code of Administrative Offenses of the Republic of Armenia, followed by a detailed investigation and assessment.
Thus, the court concluded that the administrative act in question had been adopted in violation of the law, which, according to Article 63, Part 1, "a" of the Law on the Principles of Administrative Procedure and Administrative Proceedings of the Republic of Armenia, constitutes grounds for declaring the administrative act invalid.

The decision of the Administrative Court of the Republic of Armenia in case No. VD/5842/05/21 has not been appealed and has entered into legal force.
